GDPR: the biggest thing since Y2K? - a brief introduction

The European Union has accepted the new General Data Protection Regulation (GDPR), a law designed to modernise and standardise the rules regarding security of personal data. The GDPR will become effective in May 2018. GDPR has been compared to the millenium bug in 2000, where companies had to check and double check all their systems to make sure they were ready for the 1st of January 2000.

Although many are still debating the actual impact of this new regulation, at SmartDC we believe that a few basic insights will help you prepare your company more properly. In a series of articles we will share our findings and will try to translate these in to practical do’s and dont’s.

Expanded territorial scope

The General Data Protection Regulation has expanded its territorial scope and is set to replace the Data Protection Directive 95/46/ec. Compared to the former regulations, this means that the regulation has become relevant for companies and organisations outside of the EU dealing with data of EU subjects. Any company that processes EU citizen data, whether based in the European Union or not, will have to be compliant with the GDPR. Therefore, from May 2018, not only EU companies, but companies in all continents need to consider whether they are affected by the GDPR.

The new regulation particularly imposes stricter obligations on data processors and controllers with regard to data security. It is therefore clear that especially for hosting or service providers, it is vitally important to be compliant per May 2018 in order to protect EU subjects and prevent penalties.
